By accessing the Website, the Portal or any portion thereof, you agree to be bound by the Terms and Conditions below (“Terms”):-

 1.                   Definitions and Interpretation 

1.1.             In these Terms, the following words and expressions shall, unless the context otherwise requires, have the following meanings:-

1.1.1.       “Employer” shall mean any person, firm, business, corporation, organisation, association or such other entity duly registered as an employer on the Portal. 

1.1.2.        “Jobseeker” shall mean any ex-offender duly registered as a jobseeker on the Portal. 

1.1.3.        “Portal Contents” shall mean the job vacancies posted by Employers on the Portal and/or the resumes posted by Jobseekers on the Portal.  

1.1.4.       “SCORE” shall mean the Singapore Corporation of Rehabilitative Enterprises, its officers, employees, agents and independent contractors, and its affiliates or other partners. 

1.1.5.        “Portal” shall mean the Employment Assistance Portal and/or such other online services that SCORE may implement from time to time. 

1.1.6.       “Terms” shall mean the Terms and Conditions and any revision, amendment or variation made thereto from time to time. 

1.1.7.        “Website” shall mean the website which is located at: www.score.gov.sg or at such other Uniform Resource Locator (“URL”) as determined by SCORE in its absolute discretion from time to time. 

1.1.8.        “You” and “Users” shall refer to all persons and/or entities accessing the Website and/or the Portal, including but not limited to Jobseekers, Employers and/or recruiters.  

1.2.            Where the context so admits, words in these Terms importing the singular meaning shall include the plural meaning and vice versa, words for the masculine gender shall include the feminine and neuter gender and vice versa, and words denoting natural persons shall include unincorporated associations and corporations and all such words shall be construed interchangeably in that manner. 

1.3.            The headings in these Terms are inserted only as a matter of convenience and shall in no way define, limit, construe or describe the scope or intent of the clauses of these Terms.  

2.                   Changes 

2.1.             Terms 

2.1.1.        SCORE reserves the right to amend, vary or to add to these Terms from time to time.  Any such amendments, variations or additions shall be effective immediately upon notification on the Website. You should review these Terms from time to time so that you will be apprised of any changes.  By continuing to use the Website and/or the Portal after such notification, you represent that you agree to be bound by the Terms, so amended, varied or added to, from time to time. 

2.2.             Website and Portal 

2.2.1.       SCORE reserves all rights to update or to modify the Website and/or the Portal from time to time. 

2.2.2.       SCORE may modify or discontinue any information or features that form part of the Website and/or the Portal at any time, with or without notice to you, and without liability. 

3.                   Access to the Website and/or Portal 

3.1.            The accessibility and operation of the Website and the Portal relies on technologies outside the control of SCORE and, as such, SCORE does not guarantee continuous accessibility or uninterrupted operation of the Website and/or the Portal.  

3.2.            SCORE reserves all rights to deny or restrict access to the Website and/or the Portal to any particular person, firm, corporation or organisation, or to block access from a particular Internet address to the Website and/or the Portal, at any time, without providing any reasons whatsoever. 

4.                    Relying on Information 

4.1.            SCORE provides the Website as a general information source only. The information provided by the Website shall not constitute professional advice. The Website may not cover all information available on a particular issue.  Before replying on the Website, you should conduct your own checks and obtain the relevant professional advice from third parties relevant to your particular circumstances. 

5.                   Security 

5.1.            Where appropriate, SCORE uses available technology to protect the security of communications made through the Website and/or the Portal. However, SCORE does not accept liability for the security, authenticity, integrity or confidentiality of any transactions and other communications made through the Website and/or the Portal. 

5.2.            You agree that Internet communications may be susceptible to interference or interception by third parties. SCORE makes no warranties that the Website and/or Portal are free of infection by computer viruses or other unauthorised software. 

6.                   Intellectual Property 

6.1.            All materials, including source code, pages, documents and online graphics, audio and video in the Website and the Portal are protected by law. The intellectual property rights in the materials is owned by or licensed to SCORE. 

6.2.             Apart from any fair dealings for the purposes of private study, research, criticism or review, as permitted by law, no part of the Website or the Portal may be reproduced or reused for any commercial purposes whatsoever without the prior written permission of SCORE. 

7.                   Hyperlinks 

7.1.            SCORE shall not be responsible or liable for the availability or content of any other Internet site linked to or from the Website. Access to any other Internet site shall be at your sole risk. SCORE shall not be responsible for any link or frame to the Website and/or the Portal created by any party.  

7.2.            SCORE reserves the right to object or disable any link or frame to or from the Website and/or the Portal at any time and without any notice. 

8.                   Registration (Portal) 

8.1.             In consideration of your accessing and use of the Portal, you agree as follows:- 

8.1.1.        to provide true, accurate, current and complete information about yourself (and your business, firm, corporation, organisation or association, where applicable) as required by the registration procedures (“Registration Particulars”); and 

8.1.2.       maintain and promptly update the Registration Particulars to keep them true, accurate, current and complete. 

8.2.            If you provide any information that is untrue, inaccurate, not current or incomplete, or which SCORE has reasonable grounds to suspect is untrue, inaccurate, not current or incomplete, SCORE may, at its absolute discretion, suspend or terminate your account and refuse any and all current or future use of the Website or the Portal (or any portion thereof). 

9.                   Account, ID and Password (Portal) 

9.1.            You shall be responsible for maintaining the confidentiality of your account, ID and/or password, and are fully responsible for all activities that occur and any charges, expenses, costs, fees incurred (if any) under your account, ID and/or password, whether or not authorised by you. 

9.2.            You should not disclose your ID and/or password to any third party or share your ID and/or password with any third party. 

9.3.            You shall immediately notify SCORE of any unauthorised use of your account, ID and/or password, or any other breach of security.  

10.               Warranty of Authority (Portal) 

10.1.        If you are accessing the Portal on behalf of any person, firm or corporation, you hereby represent and warrant that you are duly authorised to carry out such transactions on behalf of such person, firm or corporation, whom you represent.  

11.               Use of Portal and Portal Contents 

11.1.         You may do any of the following:- 

11.1.1.   post your resume online and browse for job vacancies, if you are a Jobseeker; and 

11.1.2.   post job vacancies online and search for candidates, if you are an Employer.  

Any use of the Portal and/or the Portal Contents not specifically permitted above is expressly prohibited.  In particular, but without limiting the general application of the restrictions contained in the preceding sentence, you shall not at any time do any of the following:- 

11.1.3.   reproduce or store in or transmit to any other web site, newsgroup, mailing list, electronic bulletin board, server or other storage device connected to a network or regularly or systematically store in electronic or print form, all or any part of the Portal Contents, without the prior written permission of SCORE; 

11.1.4.   modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit all or any part of the Portal Contents (including use as part of any library, archive or similar service) without the prior written permission of SCORE; 

11.1.5.    collect or store other Users’ personal data; 

11.1.6.   impersonate any person, firm corporation or entity or falsely state or otherwise misrepresent their affiliation with any person, firm, corporation or entity or forge any TCP/IP packet header or any part of the header information in any email; or 

11.1.7.    “stalk” or otherwise harass another User. 

12.               Posting Portal Contents 

12.1.         You are solely responsible for the contents of any Portal Contents.  

12.2.         SCORE does not control any Portal Contents posted by the Users and, as such, does not guarantee the accuracy, integrity or quality of such Portal Content.   

12.3.         SCORE reserves the right (which it may exercise at its sole discretion without notice) at any time to delete, move or edit any Portal Contents or portions thereof.  

13.               Use of Portal Contents by SCORE

13.1.         SCORE may use the Portal Contents without any restriction and free of any charge. 

14.               No Warranties 

14.1.         You expressly understand and agree that:- 

14.1.1.   Your use of the Website and the Portal is at your sole risk.  The Website and the Portal are provided on an “as is” and “as available” basis.  SCORE expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability or fitness for a particular purpose. 

14.1.2.   No data transmission over the Internet can be fully secure.  As a result, SCORE cannot ensure or warrant the security of any Port Contents posted to SCORE over the Internet, and you do so at your own risk. 

14.1.3.   SCORE cannot and does not confirm that each User is who they claim to be, as user authentication over the Internet is difficult. 

14.1.4.   SCORE does not verify, screen or censor the Portal Contents. SCORE is not involved in any transactions between the Employers and the Jobseekers. As a result, SCORE has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the job listings, the ability of Employers to offer job opportunities to Jobseekers or the suitability, qualifications and abilities of Jobseekers to fill job openings or any Portal Contents and makes no representation about any jobs, resumes or information provided by Users on the Portal.  

14.2.         SCORE makes no warranty that:- 

14.2.1.   any particular job will continue to be available and will not be responsible in any way in the event that an Employer has filled the vacancy at any time; 

14.2.2.    the Website and the Portal will meet your requirements; 

14.2.3.   the Website and the Portal will be uninterrupted, timely, secure or error-free; 

14.2.4.   the results that may be obtained from the use of the Website and the Portal will be accurate or reliable; 

14.2.5.   the quality of any services, information, or other material obtained by you through the Website and the Portal will meet your expectations; and 

14.2.6.   any errors in any software, the Website and/or the Portal will be corrected. 

14.3.         Any material downloaded or otherwise obtained through the use of the Website and the Portal is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the downloading of any such material. 

14.4.         No advice or information, whether oral or written, obtained by you from SCORE or through or from the Website, the Portal and/or any links thereto or therefrom shall create any warranty not expressly stated in these Terms. 

15.               Disclaimer  

15.1.         SCORE disclaims any and all responsibility or liability for:- 

15.1.1.   the accuracy, timeliness, content, completeness, legality, reliability, operability or availability of information or material in the Website and/or the Portal; 

15.1.2.   the deletion, failure to store, misdelivery or untimely delivery of any information or material; 

15.1.3.   any loss or damage resulting from any action taken or reliance made by you on information obtained through the Website, the Portal and/or any links therefrom or thereto; or 

15.1.4.   any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of the Website, the Portal or any linked website. 

16.               No Liability 

16.1.         SCORE accepts no liability for any failure to comply with these Terms where such failure is due to circumstances beyond the reasonable control of SCORE. 

17.               Limitation Of Liability 

17.1.         To the extent permitted by law, any condition or warranty which would otherwise by implied into these Terms is hereby excluded.   

17.2.         You expressly understand and agree that SCORE shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for business interruption and/or the loss of profits, goodwill, use, data or other intangible losses (even if SCORE had been advised of the possibility of such damages), resulting from:- 

17.2.1.    the use or inability to use the Website and/or the Portal; 

17.2.2.    any delay in operation or transmission, communications failure, internet access difficulties or malfunctions in equipment or software; 

17.2.3.    the use of or the reliance on any statement, opinion, representation or information on the Website and/or the Portal; 

17.2.4.    unauthorised access to or alteration of your transmissions or data; or 

17.2.5.    the statement, view or conduct of any third party accessing or using the Website and/or the Portal.  

18.               Indemnity 

18.1.         You agree to indemnify and keep SCORE fully indemnified from any claims, actions, proceedings, demands, injuries, damages, losses, expenses, costs (including legal costs on a full indemnity basis) and liabilities made by any third party due to or arising out of your access to and use of the Website and/or the Portal, your breach of these Terms, or your violation of any rights of any third party. 

19.               Fees 

19.1.         There are currently no fees for using any part of the Website and/or the Portal. However, SCORE reserves the right to introduce fees for using the Website and/or the Portal from time to time. SCORE is not responsible for any fees charged by any other Internet site (not provided by SCORE). 

20.               Invalidity 

20.1.         If any of these Terms are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall continue in full force. 

21.               Governing Law 

21.1.         The use of the Website and/or the Portal, and these Terms shall be governed and construed in accordance with the laws of Singapore and you agree to submit to the exclusive jurisdiction of the Singapore courts in any legal action or proceedings which may arise out of, or in connection with the use of the Website or the Portal, and these Terms.
